Once a budding pop-country star with an ACM Award win for New Artist of the Year and a Grammy nomination for Best New Artist, Jimmie Allen has been in legal battle after legal battle over the past two years. The “Best Shot” singer has faced not one but two lawsuits, both of which accuse him of sexual assault.
The first one was filed in May 2023 by a woman, identified only as Jane Doe, who used to be a member of Allen’s management team, Wide Open Music. In the lawsuit, she claims that Allen repeatedly raped and sexually assaulted her over an 18-month period. The lawsuit would eventually be settled in March 2024 out of court, dismissing all claims against Allen and his management company.
The second one, which was filed in June 2023, alleges that Allen initially approached a second woman, identified as Jane Doe 2, and began engaging in daily conversation over the phone. After some time had passed, the victim claims that she agreed to meet Allen in a Las Vegas hotel room in 2022, where she was then sexually assaulted.
According to Doe 2, she admitted to initially agreeing to have sex only on condition that Allen would wear a condom. Ignoring her request, he then proceeded to penetrate her without one, allegedly telling her that he wanted to get her pregnant. After being repeatedly told to stop, Allen refused and would proceed to ejaculate inside of her while she was not on birth control.
It was also alleged that Allen was secretly recording the assault with a phone hidden in the hotel room’s closet. The defendant claimed that she took the phone with her and flew home before turning it over to the police and filing a report against the singer.
Allen would later issue a statement to Billboard through his attorneys, claiming that the legal process would eventually clear him of any wrongdoing:
“We will leave it to the court to determine if taking something without permission is conversion (or stealing) — a lesson that most of us learned when we were young. The facts here don’t support what Jane Doe 2 is claiming, and we look forward to the legal process moving forward and clearing Jimmie’s name.”
Flash forward to today, and we have a new update involving the case.
On Monday, August 18th, the federal court in Tennessee issued an order finding that Allen forfeited his right to defend himself by flouting multiple court-imposed deadlines and orders in the lawsuit filed against him. This comes off the heels of a January 2024 report, which alleged that Allen was purposefully stalling the sexual assault lawsuit.
Per the order, not only had Allen failed to pay the plaintiff $5,950.00 in non-refundable mediation fees within 60 days, but he also failed to produce his cellphone containing evidence and failed to appear with local counsel. (Allen’s attorney in Nashville apparently relocated to another state and the country singer failed to get another attorney to represent him).
In other words, it seems as if Allen and his legal team simply stopped participating in the case.
In the aforementioned report from the Federal Court in the Middle District of Tennessee, Allen is now liable by default for battery, assault, invasion of privacy and infliction of emotional distress. In the ruling, Judge Aleta A. Trauger pointed to Allen’s failure to comply with deadlines.
“The defendants throughout have failed to comply with case management discovery deadlines and even failed to comply with specific Orders of this court… For these reasons, the plaintiff’s Motion for Sanctions and Judgment Against Defendants Jimmie Allen and Aadyn’s Dad Touring, Inc. is GRANTED.”
Also involved in the lawsuit is Charles Hurd, Allen’s personal bodyguard and alleged Aadyn’s Dad Touring (ADT) employee. For Hurd, the lawsuit accuses him of failing his duty to protect the plaintiff “from the risk of sexual abuse and surreptitious recording by Allen,” per the complaint obtained by Rolling Stone.
In a statement to Billboard, Doe 2’s attorney, Elizabeth Fegan, praised the ruling:
“We are pleased that the court entered judgment in her favor and look forward to proving her damages. The court’s ruling makes clear that Allen cannot simply ignore the serious consequences of his actions.”
The accuser, Jane Doe 2, can now file a motion against both Allen and ADT to determine the prospect of monetary damages. The post Jimmie Allen Found Liable For Sexual Assault After Failure To Comply With Court Orders first appeared on Whiskey Riff.
