Still not over.

For the past two years, Jimmie Allen has been embroiled in litigation after being sued by two women accusing him of sexual assault.

The first one was filed in May 2023 by a woman, identified only as Jane Doe, who used to be a member of Allen’s management team, Wide Open Music. In the lawsuit, she claims that Allen repeatedly raped and sexually assaulted her over an 18-month period. The lawsuit would eventually be settled in March 2024 out of court, dismissing all claims against Allen and his management company.

The second one, which was filed in June 2023, alleges that Allen initially approached a second woman, identified as Jane Doe 2, and began engaging in daily conversation over the phone. After some time had passed, the victim claims that she agreed to meet Allen in a Las Vegas hotel room in 2022, where she was then sexually assaulted.

According to Doe 2, she admitted to initially agreeing to have sex only on condition that Allen would wear a condom. Ignoring her request, he then proceeded to penetrate her without one, allegedly telling her that he wanted to get her pregnant. After being repeatedly told to stop, Allen refused and would proceed to ejaculate inside of her while she was not on birth control.

It was also alleged that Allen was secretly recording the assault with a phone hidden in the hotel room’s closet. The defendant claimed that she took the phone with her and flew home before turning it over to the police and filing a report against the singer.

Allen would later issue a statement to Billboard through his attorneys, claiming that the legal process would eventually clear him of any wrongdoing:

“We will leave it to the court to determine if taking something without permission is conversion (or stealing) — a lesson that most of us learned when we were young. The facts here don’t support what Jane Doe 2 is claiming, and we look forward to the legal process moving forward and clearing Jimmie’s name.”

While one of the cases was settled, there didn’t seem to be much happening in the other lawsuit, including multiple missed deadlines from Allen and failures to comply with the scheduling order.

At one point, Allen’s attorney Alandis Brassel informed the court that he would be shutting down his practice and moving out of state, and the court ordered the country singer to find new counsel who could represent him in the Tennessee court, but a new attorney never made an appearance in the case.

Basically, Allen and his attorney all but stopped participating in the court case.

The result was that yesterday, the court entered a judgment against Allen, finding him liable for sexual assault after the plaintiff filed a motion for judgment against him. Allen failed to file a response, and Judge Aleta Trauger considered the motion for judgment unopposed while also writing that even if Allen had responded, the plaintiff’s motion “is well supported by the facts of this case.”

In her ruling, the judge ordered the plaintiff to file a motion for damages within 20 days to determine what Allen would be ordered to pay.

But after the ruling was issued, an attorney for Allen issued a statement to People indicating that they intend to fight the judge’s ruling and throwing his previous lawyers under the bus.

Ted Anastasiou, attorney for Allen, said that the order was “purely procedural” and “the direct result of his prior counsel’s repeated failures to comply with discovery obligations and court orders.” And he said that they plan to ask the judge to set aside her ruling so that the country singer can present a proper defense:

“This ruling was not based on the merits of the allegations. Mr. Allen has consistently and unequivocally maintained his innocence, and he firmly denies these accusations.

As with earlier accusations brought on the same baseless grounds, this case is equally meritless. The default judgment reflects the shortcomings of prior representation, not any wrongdoing by Mr. Allen. It is well-established that a client should not be penalized for the failures of their attorney, and Mr. Allen should not be deprived of his right to a fair defense

We intend to take immediate action to set aside this judgment and to ensure that the matter is decided on facts and evidence, rather than procedural missteps. Mr. Allen looks forward to the opportunity to clear his name in court.”

Now, it’s not as easy as going to the court and saying, “Ok, we want to play now so throw out your judgment and let’s do this.” The court has pretty broad discretion over whether to set aside her previous order, and if she chooses not to, it would then have to go to the Court of Appeals to ask them to step in.

It’s far from a guarantee that Allen will get the opportunity to litigate this case now that a judgment has been entered.
